Terms of Use for Pakpin

1. Introduction and Acceptance of Terms

1 Scope. These Terms apply to all visitors, users, and others who access or use the Service.
2 Acceptance. You accept these Terms by  using the Service in any way or creating an account.
3 Other Policies. Our Privacy Policy, Cookie Policy, Acceptable Use Policy, and any Additional Terms (e.g. payment or promotional terms) are incorporated by reference and form part of these Terms.

2. Definitions

  • “Content” means text, images, videos, listings, ads, comments, messages, user contributions, and other materials.

  • “User,” “you” means anyone who accesses or uses the Service.

  • “Ad” or “Listing” means any classified‑ad posting submitted by you.

  • “User Contributions” means any Content you post, upload, submit or make available via the Service.

  • “Acceptable Use Policy” means the document describing prohibited behavior and content.

3. Eligibility and Account Registration

1 Age requirement. You must be at least 18 years old (or the local age of majority) to register or use the Service.
2 Registration info. You agree to provide accurate, complete, and current information during registration and to keep your account data updated.
3 Account security. You are responsible for safeguarding your login credentials and for any use of your account. Notify us immediately of any unauthorized access 

4 Account suspension or termination. We reserve the right to suspend or terminate accounts if you violate the Terms or our Acceptable Use Policy, or for any other reason, without notice or liability .

4. User Obligations and Acceptable Use

4.1 Law‑abiding behavior. You agree not to post or transmit anything that is unlawful, harmful, defamatory, fraudulent, misleading, obscene or otherwise objectionable.
4.2 No prohibited content. The Service may not be used to upload or share prohibited content such as scams, spam, illicit goods, weapons, copyrighted material without permission, or content that violates privacy or other rights .
4.3 No scraping or automated data collection. You may not harvest content, use bots or scrape our Service for content or data.
4.4 Accurate listings. All listings must be honest, truthful, and comply with applicable laws and the rules set by pakpin.com. Misleading or duplicate listings may be removed .
4.5 No impersonation or privacy violation. Do not impersonate others or violate privacy rights of third parties.

5. User‑Generated Content and License

5.1 Ownership. You retain all ownership rights in your User Contributions.
5.2 License grant. By posting your Content and Listings on pakpin.com, you grant us a non‑exclusive, royalty‑free, worldwide license to use, display, distribute, reproduce, modify, adapt, and sublicense your Content in connection with our Service, including advertising and promotional activities .
5.3 Warranties about your contributions. You represent and warrant that you have rights to the Content, that it is lawful and non‑infringing, and that it does not violate any third‑party rights.
5.4 Moderation and removal. We may but are not obligated to monitor User Contributions. We reserve the right to remove any Content at our discretion that conflicts with these Terms or is otherwise objectionable.

6. Ads and Listings

6.1 Listing rules. Any ad must list real, legal goods or services. You must have the right to sell or offer the items. Listings must clearly describe condition, price, location, and contact info where required.
6.2 Limits and sanctions. We may impose limits on the number of listings per user or category, and may reject or remove listings at our discretion.
6.3 Fees or charges. If any fees apply (e.g. premium listings), those fees are described in our Payment Terms. You must pay as specified and are responsible for payment data accuracy.

7. Intellectual Property

7.1 Our rights. All rights, title and interest in pakpin.com, including software, trademarks, logos, designs, graphics, text and other Content not provided by users, are owned by us or our licensors.
7.2 Your obligations. You may only use our intellectual property as expressly permitted, e.g. in connection with normal use of the Service. Unauthorized use is prohibited.

8. Third‑Party Links and Services

8.1 External links. The Service may contain links to third‑party websites. We are not responsible for their content or practices. Interactions with such sites are between you and the third party.
8.2 Advertisements. Third‑party advertisements may appear on our site or alongside your Listings. You may not remove or obscure these ads. We are not responsible for their content .

9. Disclaimers; Warranty

9.1 As‑is. We provide the Service “as is” and “as available” without any warranties, express or implied, including merchantability, non‑infringement, or fitness for a particular purpose .
9.2 Accuracy of listings. We do not guarantee accuracy, completeness, or reliability of Listings or User Contributions, and we do not endorse any user or ad.
9.3 No liability for interactions. Any dealings between buyers and sellers (or other users) are solely between those users. We are not a party to such transactions.

10. Limitation of Liability

10.1 Exclusion. To the fullest extent permitted by law, pakpin.com and its affiliates, officers, directors, employees, agents and licensors (the “Released Parties”) shall not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, loss of data or loss arising from tournaments or user interactions, even if advised of potential damages.
10.2 Cap on damages. If any direct liability is found, our total liability is limited to the lesser of the amount you paid to us in the preceding 12 months, PKR 1,000 (or an equivalent nominal cap permitted by local law).
10.3 Exceptions. Some jurisdictions do not allow limitation or exclusion of liability; in those cases, liability is governed by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any claim, liability, loss, damages, costs or expenses (including legal fees) arising from  your misuse of the Service, your violation of these Terms, your User Contributions.

12. Termination and Suspension

12.1 By you. You may stop using the Service or close your account at any time.
12.2 By us. We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, for any reason including breach of these Terms or suspected fraud.
12.3 Effect of termination. Upon termination, your account will deactivate and your Listings may be removed. Sections that by their nature survive termination (e.g., indemnity, limitation, governing law) shall remain in effect.

13. Changes to Terms

We may modify these Terms at any time. When changes are made, we will update the “Last Updated” date. Significant changes may be communicated via email or website notice. Continuing to use the Service after changes indicates acceptance of the revised Terms. We recommend reviewing the Terms periodically.

14. Governing Law and Dispute Resolution

14.1 Governing law. These Terms are governed by the laws of Pakistan.
14.2 Dispute resolution. Any dispute arising under or relating to these Terms shall be resolved in the courts located in Lahore, Punjab, Pakistan, to which you and we hereby submit exclusive jurisdiction.
14.3 Arbitration clause. Where permitted, disputes may instead be subject to binding arbitration in Lahore, with each party bearing its own legal fees. This clause may waive rights to class action suits.

15. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal data. You should review it before using the Service. The Privacy Policy is separate from these Terms but fully incorporated herein .

16. Communications

We may send notices or communications to you via email or by postings on the Service. You agree that these shall constitute contacting you. You may opt out of non‑essential communications as described in our Privacy Policy.

17. Notifications of IP Infringement

If you believe any Content on pakpin.com infringes your intellectual property rights, please notify us by providing a written complaint including the required details (your identity, signature, description of the infringing material, etc.). We will respond in accordance with applicable laws.

18. Miscellaneous

18.1 Entire Agreement. These Terms, together with referenced policies, constitute the entire agreement between you and pakpin.com regarding the Service.
18.2 Severability. If any provision is found invalid or unenforceable, it will be limited, modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force.
18.3 Waiver. Our failure to enforce any provision shall not be deemed a waiver of future enforcement of that or any other provision.
18.4 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign rights freely.
